When we act as the processor, on behalf of our clients

Digiware Solutions has developed a solution based on artificial intelligence that allows for detecting behaviours that could potentially cause damage to people or property as well as for detecting people falling (our “Service”). Our Service is based solely on an algorithmic processing of movements and does not use facial recognition, client monitoring or identity registration. 

Our Service processes the Personal Data of our clients’ consumers, through movement detection, on behalf of and on the sole instruction of our clients (the controllers). When we supply our Service to our clients, the latter act as the controllers for your Personal Data used by our Service, whereas we are the processors.

As the controllers, our clients are solely responsible for providing you with information on the processing of your Personal Data and on exercising your rights. As the processor, Digiware Solutions assists its clients in analysing the Data processing performed via the Service, and in displaying an initial level of information in the locations where our Service is implemented.

The recipients of your data

Your rights

When we act as the controller

When Digiware Solutions acts as the controller, you can exercise the following rights, within the limits set by the Applicable Regulations:

  • Right of access and post-mortem directives: You can ask Digiware Solutions to confirm that your Data is or isn’t processed, as well as for the provision of your Data held by us. You also have the right to set directives on the fate of your Data after your death;
  • Rectification, restriction and erasure: You can ask Digiware Solutions to rectify any of your Personal Data that is inaccurate, as well as to complete incomplete personal Data. You can also ask Digiware Solutions to restrict processing of or erase your Personal Data as soon as possible once Digiware Solutions no longer needs to keep it;
  • Objection and withdrawal of consent: You can object to your Data being processed on legitimate grounds. You can always, and without cost, object to receiving any marketing communication from us. You can also withdraw your consent when the processing of your data is based on this consent;
  • Portability: On request, Digiware Solutions will send you the Personal Data you have provided to us and, in as far as possible, will provide this Data directly to another controller of your choice, in a portable format if the processing is based on your consent or on a contract;

The request must come directly from the person concerned, who must be able to prove their identity. A copy of your ID document may be requested, within the limits of the Applicable Regulations. Digiware Solutions will strive to follow up on your request as quickly as possible and, in any event, within the periods set out in the Applicable  regulations.

When we act as the processor

When Digiware Solutions acts as the processor of your data, we will, with our clients, give you an initial level of information, but only our clients shall be responsible for informing you about exercising your rights and allowing you to exercise these.

To exercise data protection rights, we ask our clients’ consumers using our Service to make their requests directly to the appropriate client (the controller).

Entry into force

  • This Confidentiality Policy entered into force on 12 February 2025.
  • We may have to modify or update this Confidentiality Policy. We recommend you view this page regularly to find out any changes or updates made to our Confidentiality Policy.
